The Medicare Prescription Drug, Improvement, and Modernization Act of 2003 requires entities that provide prescription drug coverage to Medicare Part D eligible individuals to disclose to CMS whether the prescription drug coverage is creditable or non-creditable. CMS has updated the Disclosure to CMS Form and Instructions which provide guidance on the form, manner and timing of providing the Disclosure to CMS Form and outlines how to complete the on-line Disclosure to CMS Form. CMS has also published the policy portion of the Form and Instructions in a separate guidance document for use by those individuals that are only interested in the Disclosure to CMS policy provisions.
To be in compliance with Medicare Part D regulations, you must disclose any eligible individuals with creditable coverage status to the Centers for Medicare & Medicaid Services (CMS) within 60 days after the beginning date of the plan year. This must be done by submitting disclosure information to CMS using the electronic format and related guidance found in the Medicare section of the CMS Website (www.cms.hhs.gov). If your group health plan has already been renewed for the year 2007 and you have not yet done so, please visit the above mentioned website to submit your disclosure at this time.

An entity is required to provide disclosure through completion of the Disclosure to CMS Form located in the Creditable Coverage Notice to CMS Guidance Form unless specifically exempt as outlined in the updated documents.
